New resource: Legislative approaches to curb corporate influence in health care

A new AMA state advocacy resource, “Legislative approaches to curb corporate influence in health care,” (PDF) details burgeoning state legislative activity around private equity in a health care environment rife with corporate investment. Based on an analysis of recently proposed and enacted state legislation, this report offers a novel 5-part framework for understanding how states may address corporate influence on the practice of medicine.

  1. improving transparency and oversight of transactions involving corporate actors through health care transaction review laws 

  2. protecting the independent clinical judgment of physicians by strengthening the corporate practice of medicine doctrine 

  3. limiting the influence management services organizations (MSOs) may exert influence on physician practices 

  4. supporting fair contracting in physician employment agreements  

  5. protecting patient access to care in consolidated markets
