Post-Test Confidentiality

Upon receiving her positive test results Rebecca begs you to withhold the information from her chart.

Rebecca: I am so afraid my insurance company is going to drop me. I'm so young and now I'm at greater risk for breast cancer, please don't record my results.

You reply: Rebecca, based upon your family history your insurance company may have declined you as a client. And now that you have a positive test result, you are covered by HIPAA, as well as the local state laws. (See Genetic Discrimination discussed under Non-Directive Counseling)

Rebecca is not convinced and still asks you to withhold her information from her permanent medical record.

Rebecca: I know my insurance company is going to raise my premiums if they ever locate this information. Please don't record it in my medical record.
