GOVERNMENTNews in brief - April 3, 2006Group settles with N.J. pathologist Group settles with N.J. pathologistA New Jersey physician in March received a $700,000 settlement in a whistle-blower lawsuit. Pathologist Ali Daneshvar, MD, claimed Atlantic Pathologists, where he was a partner, and AtlantiCare Regional Medical Center billed Medicare for testing without inserting the proper diagnosis codes. Dr. Daneshvar alleged the group terminated him in 2002, because he sent a letter in 2001 reporting the alleged fraud to the Office of the Inspector General. Dr. Daneshvar was seeking protection under the New Jersey Conscientious Employee Protection Act. But the case settled during jury trial deliberations in Atlantic County Civil Court. His attorney, Mark Pfeffer, said the case settled because the jury's questions indicated they were going to find in favor of Dr. Daneshvar. Atlantic Pathologists' attorney James Cutro said the group denies the allegations in the lawsuit and that fraudulent billing took place. Cutro said they settled the case "for business reasons."
